What the Words Mean: As these RBC Referral Awards Program Terms and Conditions (“Terms and Conditions”) are read, please remember that, “you” or “your” means the Eligible Participant who has enrolled in the RBC Referral Awards Program (“Program”); and “Royal Bank”, “RBC”, “we”, “us” or “our” means Royal Bank of Canada.

Please also remember that in these Terms and Conditions:

  • "Authorized User" means an individual, other than the Primary Applicant and the Co-Applicant, to whom we issue a Card on a Net Purchase Personal Credit Card Account at the request of the Primary Applicant or the Co-Applicant;
  • Avion Rewards Program”means the rewards program administered by Royal Bank and pursuant to which program members may earn Points when using various Royal Bank products, which may in turn be redeemed for a variety of Rewards as per the Avion Rewards Terms;
  • “Avion Rewards Terms”means the Avion Rewards Terms and Conditions that are governing the Avion Rewards Program, which are available at: https://www.avionrewards.com/terms-and-conditions/;
  • “Business Credit Card Account” means any business credit card account that allows Cardholders to earn Points;
  • "Card" means any credit card that we issue on a Credit Card Account and all re-issuance of, and replacements for, that credit card;
  • “Cardholder” means an individual to whom we issue a Card;
  • “Co-Applicant" means an individual who applies for a Net Purchase Personal Credit Card Account as the co-applicant, and to whom we issue a Card;
  • “Credit Card Account” means any Net Purchase Personal Credit Card Account or Business Credit Card Account. For greater certainty, commercial RBC credit card accounts are excluded from the definition of Credit Card Account;
  • Eligible Banking Rewards Account” means any of the following eligible personal RBC banking accounts that is held in “Sole” or “Joint OR” ownership, and that allows Eligible Participants to earn Points in accordance with this Program: RBC Day to Day Banking®, RBC Advantage Banking, RBC Signature No Limit Banking®, RBC VIP Banking®, RBC Day to Day Savings®, RBC Enhanced Savings®, RBC High Interest eSavings®, RBC No Limit Banking® (discontinued), RBC Student Banking® (discontinued), RBC No Limit Banking for Students® (discontinued), as well as any other banking account that we may add to this list from time to time. For greater certainty, personal RBC banking accounts that are held in “Joint AND” ownership are excluded from the definition or Eligible Banking Rewards Account;
  • “Eligible Participant” means an individual who is a Canadian resident and is either: (i) working as a duly licensed real estate agent anywhere in Canada other than in the province of Quebec; (ii) builder, builder’s agent, representative or employee who has enrolled in the Program and meets all the Program’s eligibility requirements in accordance with applicable laws, or (iii) an insurance broker, independent financial planner/advisor, lawyer or accountant and any other eligible participant as determined by Royal Bank from time to time, who has enrolled in the Program and meets all the Program’s eligibility requirements in accordance with applicable laws and/or the Eligible Participant’s respective industry, professional and regulatory requirements and obligations;
  • “Eligible Person” means an individual who currently owns or will be purchasing a property that meets our lending criteria for residential mortgage properties and whose mortgage(s) has(ve) been identified by Royal Bank from time to time as meeting the eligibility requirements for an Eligible Participant to earn Points or receive Non-Points Recognition under the Program in respect of a Qualified Mortgage;
  • “Fully Advanced Qualified Mortgage Referral” means a referral that satisfies the criteria set out in paragraphs 3(a)(i) and 3(a)(ii) below;
  • “Good Standing” means, (i) for your RBC Referral Awards Account, that you are still enrolled in the Program and that your RBC Referral Awards Account has not been closed, and (ii) for your Credit Card Account or Eligible Banking Rewards Account, it has the meaning given in the “Accounts in Good Standing” section of the Avion Rewards Terms;
  • Joint Account Owner” means a co-owner of an Eligible Banking Rewards Account, other than the Primary Account Owner;
  • “Net Purchase” means the full amount charged to a Credit Card Account for a purchase of goods and/or services made by a Cardholder, including taxes, less any credit;
  • "Non-Points Member" means an Eligible Participant who may only receive Non-Points Recognition under the Program, but may not earn Points;
  • "Non-Points Recognition" means a recognition that an Eligible Participant may receive under the Program, other than Points, such as invitations to participate in various activities and events;
  • “Net Purchase Personal Credit Card Account” means any Royal Bank of Canada personal credit card account that allows (i) Cardholders to earn Points on Net Purchases at a base earn rate in accordance with the Avion Rewards Program, and (ii) Eligible Participants to earn Points in accordance with this Program;
  • "Point"means an Avion  point;
  • "Points Member" means an Eligible Participant who may earn Points and receive Non-Points Recognitions under the Program;
  • "Primary Account Owner" means the person that we consider to be the main owner of an Eligible Banking Rewards Account. When the Eligible Banking Rewards Account is jointly owned with one (1) or more Joints Account Owners, it is the first person listed as an owner, per our records;
  • “Primary Applicant” means the individual who has applied for, and who is the primary Cardholder on, a Net Purchase Personal Credit Card Account. For greater certainty, the definition of Primary Applicant does not include a Co-Applicant or an Authorized User;
  • "Program" means the RBC Referral Awards Program;
  • “Qualified Mortgage” means a first-ranking mortgage or RBC Homeline Plan® mortgage to Royal Bank on a Residential Property. A Qualified Mortgage includes a mortgage in respect of a purchase or a switch/transfer of a mortgage from another financial institution to Royal Bank. A Qualified Mortgage does not include a mortgage in respect of: (1) raw land; (2) commercial property; (3) Residential Property that is, at the time of the referral, already mortgaged to Royal Bank, Royal Trust Corporation of Canada or The Royal Trust Company; or (4) Residential Property that is, at the time of the referral, mortgaged to Royal Bank, but that the Eligible Person intends to sell and obtain mortgage financing for the purchase or acquisition of another Residential Property;
  • “Qualified Mortgage Referral” means the provision, by an Eligible Participant to an RBC mortgage specialist, of the name and contact information for a person who is subsequently determined by Royal Bank to be an Eligible Person;
  • "RBC Referral Awards Account" means the account that we open in your name for the tracking of Qualified Mortgage Referrals, as well as Points and Non-Points Recognition earned or received under the Program;
  • “Rewards Account” means the nominal account tied to: (i) a Credit Card Account or a Card, or (ii) an Eligible Banking Rewards Account, that Royal Bank opens and maintains for the crediting and debiting of Points earned in connection with the Avion Rewards Program, this Program or any other RBC program that allows its respective participants to earn Points;
  • "Recognition” means either Points or a Non-Points Recognition earned or received under the Program;
  • Residential Property” means a property located in Canada, other than in the province of Quebec that is used entirely for residential housing. For multiple unit dwellings, it means a property containing no more than six (6) units; and
  • "Reward(s)" means any reward for which Points may be redeemed for under the Avion Rewards Program.

You agree with us as follows:

1.General Terms and Conditions:

(a)
These Terms and Conditions apply to the Program and to your access to the RBC Referral Awards website, available at: https://referralawards.rbc.com.
(b)
These Terms and Conditions replace all prior terms and conditions with respect to the Program.
(c)
An Eligible Participant can elect to enroll in the Program either as a Points Member or a Non-Points Member, provided that an Eligible Participant in the Province of Alberta may only enroll in the Program as a Non-Points Member and shall not enroll as a Points Member. If you are a Non-Points Member who is not residing in the Province of Alberta, you may elect to change your participant status to that of Points Member at any time. Likewise, a Points Member may elect to change its participant status to that of Non-Points Member at any time.
(d)
If you enroll in this Program as a Points Member, the Avion Rewards Terms that were provided or made available to you when you became a member of the Avion Rewards  Program, continue to apply. The Avion Rewards Terms can be found at: https://www.avionrewards.com/terms-and-conditions/.
(e)
In case of discrepancy between these Terms and Conditions and the Avion Rewards Terms, the Avion Rewards Terms will prevail.
(f)
Capitalized terms not defined herein have the meaning given to them in the Avion Rewards Terms.
(g)
The Program is offered to you at no cost or charge.
(h)
As a member of the RBC Referral Awards program, you have opted in to receive all emails related to this program, which may include the promotion of other RBC Royal Bank products and services. You can opt out of program emails at any time here: https://referralawards.rbc.com/email-preferences.php. For RBC clients, this opt-in does not impact choices you may have made regarding other communications from RBC.

2.Eligibility:

(a)
To enroll in the Program, an Eligible Participant must comply at all times with all applicable federal and provincial legislation and regulations including, without limitation, all applicable real estate, mortgage broker or other licensing requirements, as well as the regulations of any real estate governing body or association, including with respect to disclosure of compensation arrangements.
(b)
Eligible Participants agree to, and shall fulfill, all ongoing licensing, certification and/or registration requirements and obligations and/or restrictions, including with respect to remuneration, from all respective and recognized professional and regulatory bodies, industry associations and/or government or related authorities within the appropriate jurisdiction(s).
(c)
In consideration of your enrollment in the Program, you hereby release, indemnify and hold Royal Bank harmless against any and all claims whatsoever arising as a result of your failure to comply, in whole or in part, with any such applicable legislation, regulations and requirements.
(d)
Employees of Royal Bank, its subsidiaries or its affiliates are not eligible to enroll in the Program.
(e)
You acknowledge that your participation in the Program is solely for your benefit and that you may not share or transfer the Recognition(s) you earn under the Program with/to another person.

3.Qualified Mortgage Referrals:

(a)
To receive a Recognition: (i) the mortgage referral of a person must be determined by Royal Bank to be a Qualified Mortgage Referral, (ii) the mortgage referral must result in a fully advanced first ranking residential mortgage or RBC Homeline Plan® mortgage on the Residential Property, and (iii) your RBC Referral Awards Account and, if you are a Points Member, your Credit Card Account (and/or Card) or your Eligible Banking Rewards Account, must be in Good Standing at that time the Recognition is received.
(b)
You acknowledge that you will only receive a Recognition if the criteria set out in paragraph 3(a) above are satisfied, and that not all persons referred to Royal Bank will qualify as an Eligible Person.
(c)
You further acknowledge that Royal Bank may, in its sole discretion, refuse to qualify any person referred for financing as an Eligible Person, regardless of qualifications.
(d)
Royal Bank shall have no liability whatsoever for refusing to award a Recognition to you for a person you have referred, unless the criteria in paragraph 3(a) above are satisfied.

4.Compliance and Disclosure Requirements:

(a)
You shall disclose to each person that you refer to us that you will be sharing their name, address, email, telephone, fax or website contact information with us for purposes of facilitating a Qualified Mortgage Referral, and you shall obtain their consent in such form as required under applicable law, to the sharing of name and contact information with us. You shall also disclose in accordance with applicable law the fact that you may receive compensation from us in respect of a Qualified Mortgage Referral.
(b)
You understand and agree that you are not authorized to provide any details or make any representations or provide any advice to any person on any of our products and services, including on residential mortgages and RBC Homeline Plans, or in relation to any lending criteria employed by us. You further acknowledge and agree that you are not authorized to, nor will you collect any personal or financial information from any person that would enable the assessment or determination of eligibility for a residential mortgage or RBC Homeline Plan with Royal Bank, and you will not consider any eligibility criteria before referring such person to us.
(c)
You agree that these Terms and Conditions are strictly confidential and shall not be disclosed in any fashion to, nor a copy of these Terms and Conditions shared with, any third party. The disclosure or sharing of these Terms and Conditions to/with any third party is grounds for the immediate termination of your participation in the Program by us and the forfeiture of any Recognitions received by you under the Program.
(d)
You warrant that you: (i) are in compliance, and committed to comply with, all applicable laws relating to the prevention of bribery, corruption, or similar activities, including (without limitation) the Corruption of Foreign Public Officials Act (Canada), as amended, and the rules and regulations thereunder, and all similar laws, rules, and regulations of any jurisdiction applicable to you (“Anti-Bribery and Anti-Corruption Laws”); (ii) are not a public official, or politically exposed person as of the date you enrolled in the Program, and (iii) will facilitate and assist Royal Bank in the performance of any reviews or investigations related to the breach of any Anti-Bribery and Anti-Corruption Laws.
(e)
Unless and to the extent prohibited by law, you shall immediately notify us if you are under investigation or charged with an offence of corruption or any other offence constituting an illegal or corrupt practice.
(f)
Notwithstanding the provisions of section 13, any violation by you of any applicable Anti-Bribery and Anti-Corruption Laws will be considered a material breach of these Terms and Conditions, and Royal Bank may, without limiting any other remedy it has, terminate your participation in the Program without notice. Should this happen, your Recognitions will be immediately forfeited.

5.Recognitions:

(b)
Your Level in the Program is determined by your number of Fully Advanced Qualified Mortgage Referrals in the previous twelve (12) months period (“Period”) and is re-evaluated each month, as follows.
(c)
As soon as you enroll in the Program, the initial twelve (12) months period starts, but retroactively to the first day of that month. For example, if you enrolled in the Program on September 12, 2021, the initial Period applicable to you will be from September 1, 2021 to August 31, 2022. Your Level in the Program may move from Key Partner to VIP Partner or Elite Partner during that initial Period
(d)
After the initial Period is over, the Period used to establish your Level in the Program will shift by one (1) month, each month. For example, if the initial Period was from September 1, 2021 to August 31, 2022, the following Periods will respectively be from October 1 2021 to September 30, 2022 (“Period 2”), then from November 1, 2021 to October 31, 2022 (“Period  3”), then from December 1, 2021 to November 30, 2022 (“Period 4”), and so on.
(e)
This means that your Fully Advanced Qualified Mortgage Referrals will be re-calculated, and your Level in the Program will be re-evaluated, each month. This also means that your Level in the Program may fluctuate upward or downward from one month to another. For example, if you are a Points Member at the Elite Partner Level in the month of October 2021 because you have eleven (11) or more Fully Advanced Qualified Mortgage Referrals in Period 3, but your number of Fully Advanced Qualified Mortgage Referrals is only eight (8) in Period 4, your Level will move down to the VIP Partner Level for the month of November 2021, and you will earn 16,000 Points per Eligible Mortgage Referral that month.
(f)
We will indicate your number of Fully Advanced Qualified Mortgage Referrals and the Recognition you have received for each of them on your RBC Referral Awards Account dashboard, available at: https://referralawards.rbc.com.
(g)
Your RBC Referral Awards Account dashboard will be updated on a bi-weekly basis.
(h)
Recognitions awarded under the Program have no cash value, and cannot be exchanged for cash. Points awarded under the Program do not constitute your property for any purpose.

5.1.Points:

(a)
Points may only be awarded to Points Members.
(b)
To participate in the Program as a Points Member, an Eligible Participant must either: (i) be the Primary Applicant or the Co-Applicant on a Net Purchase Personal Credit Card Account, (ii) be the Primary Account Owner or a Joint Account Owner of an Eligible Banking Rewards Account, or (iii) have a Card on a Business Credit Card Account and have redemption rights over the Points in the Rewards Account tied to the Card, as per the “Points Ownership” section of the Avion Rewards Terms. It is you responsibility to ensure that such Card is tied to an Rewards Account over which you have redemption rights.
(c)
An Eligible Participant who is an Authorized User on a Net Purchase Personal Credit Card Account or who has a Card on a commercial RBC credit card account is not eligible to participate in the Program as a Points Member.
(d)
If you are a Points Member, the Points earned for a Fully Advanced Qualified Mortgage Referral will be displayed on your RBC Referral Awards Account dashboard, but will be credited to the Rewards Account tied to (i) your Credit Card Account (note: if you have a Card on a Business Credit Card Account, the Rewards Account is tied to the Card, not the Business Credit Card Account), or (ii) your Eligible Banking Rewards Account, at your choice.
(e)
This means that you will only be able to redeem the Points from your Rewards Account, not from your RBC Referral Awards Account. You may track and use your Points at avionrewards.com or in the Avion Rewards app.
(f)
As soon as the Points are credited to your Rewards Account, they are subject to the Avion Rewards Terms.
(g)
If you participate in the Program as a Points Member because you are the Primary Applicant or the Co-Applicant on a Net Purchase Personal Credit Card Account, you understand that the Points earned under the Program will also be accessible and available for redemption, transfer and conversion by the other Primary Applicant or Co-Applicant, as applicable.
(h)
If you participate in the Program as a Points Member because you are the Primary Account Owner or a Joint Account Owner of an Eligible Banking Rewards Account, you understand that the Points earned under the Program will only be accessible by you; they will not be accessible nor available for redemption, transfer and conversion by the other Primary Account Owner or Joint Account Owner(s), as applicable, unless such other Primary Account Owner or Joint Account Owner(s) is/are also enrolled in the Program. However, if the Eligible Banking Rewards Account is also enrolled in the RBC Value Program[1], the Points earned under the Program will be accessible and available for redemption, transfer and conversion by the co-owner of the Eligible Banking Rewards Account (if there is one), even if such co-owner is not participating in the RBC Referral Awards Program.
(i)
It may take up to six (6) weeks from the time that Royal Bank determines that the mortgage referral is a Fully Advanced Qualified Mortgage Referral, for the Points earned to be credited to your Rewards Account.
(j)
Points earned under the Program for Fully Advanced Qualified Mortgage Referral(s) will appear on your RBC Referral Awards Account dashboard, as well as in your “Points Activity” at avionrewards.com and in the Avion Rewards app. However, please note that these portals will only be updated on a bi-weekly basis with the Points you earned under the Program.
(k)
If you have more than one (1) Fully Advanced Qualified Mortgage Referral processed in one (1) bi-weekly period, the Points earned for each Fully Advanced Qualified Mortgage Referral will appear as separate entries on your RBC Referral Awards Account dashboard.
(l)
If you have opted for the Points to be credited to the Rewards Account tied to your Credit Card Account/Card (if you have one), the sum of all Points earned during a monthly statement period, for (i) all Fully Advanced Qualified Mortgage Referrals, and (ii) your net purchases, will appear as one (1) entry on your Credit Card Account monthly statement. In other words, the Points earned for each Fully Advanced Qualified Mortgage Referral will not appear as separate entries on your Credit Card Account monthly statement. Also, if you have more than one (1) Fully Advanced Qualified Mortgage Referral processed in one (1) bi-weekly period, the sum of all Points earned for all Fully Advanced Qualified Mortgage Referral(s) during that bi-weekly period will appear as one (1) entry in your “Points Activity” at avionrewards.com or in the Avion Rewards app.
(m)
If you have opted for the Points to be credited to the Rewards Account tied to your Eligible Banking Rewards Account (if you have one), the Points earned for each Fully Advanced Qualified Mortgage Referral processed in one (1) bi-weekly period will appear as separate entries in your “Points Activity” at avionrewards.com or in the Avion Rewards app.

5.2.Points earned with your Eligible Banking Rewards Account

(a)
If you participate in the Program as a Points Member because you have an Eligible Banking Rewards Account, the type of personal RBC credit card that you have, if you have one, will determine if your Eligible Banking Rewards Account is an Avion Account or a Non-Avion Account and therefore, if you can redeem the Points earned under this Program for Air Travel Rewards (as defined in the Avion Rewards Terms), which is an option that is only offered to Avion Air Travel Rewards Participants (as defined in the Avion Rewards Terms).
(b)
If you do not have a personal RBC credit card account, or if you have one that is not a Net Purchase Personal Avion Credit Card Account (as defined in the Avion Rewards Terms), your Eligible Banking Rewards Account will be categorized as a Non-Avion Account, you will not be considered an Avion Air Travel Rewards Participant and you will not be able to redeem the Points earned under this Program for Air Travel Rewards (which means air travel in accordance with the Redemption Schedule (as defined in the Avion Rewards Terms)). You will however be able to redeem your Points for air travel and other types of RBC Travel Rewards (as defined in the Avion Rewards Terms) at the rate of 100 Points per $1.00 CAD.
(c)
If you have a Net Purchase Personal Avion Credit Card Account, your Eligible Banking Rewards Account will be categorized as an Avion Account and you will also be able to redeem the Points earned under this Program for Air Travel Rewards.
(d)
If you close your Net Purchase Personal Avion Credit Card Account or change it for a personal RBC credit card account that is not a Personal Avion Credit Card Account, your Eligible Banking Rewards Account will automatically be changing from an Avion Account to a Non-Avion Account, whether your Eligible Banking Rewards Account remains open or has been closed. This means that you will lose your Avion Air Travel Rewards Participant status and that you will no longer be able to use the Points earned under this Program, nor any future Points that you may earn under this Program (provided your Eligible Banking Rewards Account remains open), to redeem Points for Air Travel Rewards.  You will however be able to continue to redeem your Points for air travel and other types of RBC Travel Rewards at the rate of 100 Points per $1.00 CAD.
(e)
If you open a Net Purchase Personal Avion Credit Card Account or change your personal RBC credit card account (that is not a Personal Avion Credit Card Account) for a Net Purchase Personal Avion Credit Card Account, your Eligible Banking Rewards Account will automatically be changing from a Non-Avion Account to an Avion Account, whether your Eligible Banking Rewards Account remains open or has been closed. This means that you will automatically become an Avion Air Travel Rewards Participant and that you will be able to use the Points earned under this Program, as well as any future Points that you may earn under this Program (provided your Eligible Banking Rewards Account remains open), to redeem Points for Air Travel Rewards.

5.2.Non-Points Recognition:

(a)
Non-Points Recognition may be awarded to Non-Points Members and Points Members, in addition to Points.
(b)
Royal Bank will establish, in its sole and absolute discretion, what Non-Points Recognitions may be awarded, and the frequency for awarding them.
(c)
Non-Points Recognitions will not be awarded to you each time that you reach another Level.

6.Verification:

(a)
It is your responsibility to verify your number of Fully Advanced Qualified Mortgage Referrals and track your Recognitions by verifying your RBC Referral Awards Account dashboard, as well as your “Points Activity” at avionrewards.com or in the Avion Rewards app, regularly.
(b)
You must notify us in writing of any errors, omissions, or objections to the activity on your RBC Referral Awards Account dashboard, or to your “Points Activity” at rbcrewards.com or in the Avion Rewards app, within ninety (90) days from the date indicated as such on your RBC Referral Awards Account dashboard, at avionrewards.com or in the Avion Rewards app, by sending us a notification: Connect with your Mortgage Specialist for assistance.
(c)
If you do not notify us as required, we are entitled to treat the status of your Fully Advanced Qualified Mortgage Referrals and Recognitions as complete, correct and binding on you and you release us from all claims in respect of those Fully Advanced Qualified Mortgage Referrals and Recognitions.
(d)
We have the right to audit all Fully Advanced Qualified Mortgage Referrals in order to validate the information submitted.
(e)
We reserve the right to disallow any Recognition that was awarded to you, for any reason, and to disqualify any Eligible Participant if any form of misrepresentation has occurred.
(f)
We also reserve the right to make any adjustments and correct any errors pertaining to your Points, at any time and for any reason, including if Points have been erroneously earned or credited to your Rewards Account, or earned at an incorrect, higher rate.
(g)
Any adjustment to a Recognition arising as a result of an audit can be completed up to one (1) year from the activity date indicated in your RBC Referral Awards Account dashboard.

7.Limit to our Responsibility:

(a)
In no event will Royal Bank be liable or responsible for, and you and your heirs, executors, liquidators, administrators and assigns release us and each of our affiliates, subsidiaries, officers, directors, employees and agents from all claims in respect of any loss, damage or inconvenience suffered by you or others howsoever arising, including but not limited to, those caused by:
  1. our failure to award a Recognition to you in accordance with these Terms and Conditions, for whatever reason, including as a result of a mistake, error, omission, interruption, deletion of files or email, defect, viruses, delay in operation or transmission, whether resulting or not from an act of God, or from theft, destruction or unauthorized access to our records, programs or services;
  2. your failure to notify us in writing of any error, omission or objections to the activity on your RBC Referral Awards Account dashboard, or to your “Points Activity” at rbcrewards.com or in the Avion Rewards app, as per the “Verification” section of these Terms and Conditions;
  3. our right to disallow or adjust a Recognition that was awarded to you, in accordance with these Terms and Conditions;
  4. the suspension or termination of the Program for any reason;
  5. the suspension or termination of your participation in the Program, the closing of your RBC Referral Awards Account or the cancellation of any or all of your Recognitions in accordance with these Terms and Conditions, for any reason;
  6. our failure to send you any communication as set out in these Terms and Conditions; or
  7. for Non-Points Recognitions, the performance or action of a third party supplier or their failure to perform as expected.
(b)
Royal Bank will not be liable for any indirect, consequential, special, aggravated, punitive or exemplary damages whatsoever caused to you directly or indirectly arising out of or related to the Program, our administration of the Program (including any amendment of these Terms and Conditions) or your participation in the Program.

8.Death/Divorce:

(a)
Recognitions earned are not divisible in case of death, divorce, separation, dispute, legal proceedings, closure of an RBC Referral Awards Account or for any other reason.
(b)
Upon the death of an Eligible Participant who has been awarded Recognitions under the Program, the Eligible Participant's enrolment in the Program will terminate, the RBC Referral Awards Account will be closed, and all Non-Points Recognitions will automatically be invalidated.
(c)
If the deceased Eligible Participant was a Points Member, Points earned under the Program will be governed by the “Account Closure by Us In The Event of Death” section of the Avion Rewards Terms.

9.Collection and Use of Information: :

(a)
By providing information to us and enrolling in the Program, you request that we communicate with you using the contact information that you have provided, including your email address.
(b)
We may act on your communication preferences recorded in the Program website. You also permit us to collect the information submitted by you and other information generated in the course of the Program, and to use and share it with other RBC® companies, service providers, and participating merchants for the purposes of administering the Program and fulfilling redemption requests under the Program and as required or permitted by law. Royal Bank and these other companies may communicate with you through various channels, including telephone, computer or mail, using the contact information you have provided. With your consent, we may send you emails about RBC products, services, offers and promotions.
(c)
We may also use this information and share it with RBC companies (i) to manage our risks and operations and those of RBC companies, (ii) for internal purposes, including statistical and other analysis and the creation of new or amended programs, (iii) for marketing purposes, including the provision to you of offers or contests and (iv) to comply with valid requests for information about you from regulators, government agencies, public bodies or other entities who have a right to issue such requests.

10.Waiver:

(a)
Any waiver by us of the strict observance, performance or compliance by you of any term, condition or agreement contained herein and any extension of time or other indulgence granted by us, either expressly or by course of conduct, shall not alter, affect or prejudice any of our other rights or remedies and shall be effective only in the specific instance and for the purpose for which it was given and shall be deemed not to be a waiver of any of our rights and remedies hereunder as a result of any other breach hereunder.
(b)
No delay or omission by us in exercising any right or remedy hereunder shall operate as a waiver thereof or of any other right or remedy.

11.Tax:

(a)
Points awarded under the Program for Qualified Mortgage Referrals are considered taxable income.
(b)
Royal Bank will issue tax slips that report the value of cumulative points awarded to you during applicable taxation years when the value of those cumulative points are greater than $500 for applicable taxation years during which Points are awarded.
(c)
Valuation of the Points for tax reporting purposes is based on the average redemption value of the different types of redemption options. This valuation of the Points is subject to change for applicable taxation years.
(d)
Eligible Participants should consult with their personal tax advisor(s) regarding tax implications and are responsible for reporting this information for tax purposes.
(e)
Any personal federal and/or provincial tax liability arising from the award of Points is your responsibility.

12.Changes to the Program:

(a)
We may change the Program and these Terms and Conditions, in whole or in part, from time to time.
(b)
Program changes may include, but are not limited to, changes to:
  1. any of the defined terms;
  2. the Program eligibility and enrolment requirements;
  3. the list of Eligible Banking Rewards Accounts and what constitutes an Eligible Banking Rewards Account;
  4. the conditions to be met for an Eligible Participant to receive a Recognition;
  5. what constitutes a Fully Advanced Qualified Mortgage Referral;
  6. the compliance and disclosure requirements applicable to Eligible Participants;
  7. the number of Fully Advanced Qualified Mortgage Referrals to qualify for the various “Levels” and the Period applicable for the calculation;
  8. the number of Points to be earned per Fully Advanced Qualified Mortgage Referrals;
  9. the type of products that may allow you to participate in the Program as a Points Member and earn Points in accordance with the Program;
  10. where and how can Points be tracked and accessed, and by who;
  11. the rules relating to Points earned with an Eligible Banking Rewards Account, and those relating to Avion Accounts and Non-Avion Accounts;
  12. the rules relating to the: (a) suspension or termination of your participation in the Program, (b) suspension or termination of the Program, (c) your withdrawal from the Program, and (e) closure of your RBC Referral Account, and the associated consequences;
  13. the rules relating to errors in the allocation of Recognitions and the handling of complaints;
  14. the rules relating to our (non) liability and responsibility;
  15. the rules relating to the collection and use of your information; and
  16. the provisions related to the modification of all or any of these Terms and Conditions.
(c)
We may also change the Program and these Terms and Conditions, to add features or attributes to the Program from time to time, which may include other benefits or forms of rewards, incentives, tools, or opportunities that may be incorporated into the Program.
(d)
At least thirty (30) days prior to a change that we consider to be an essential element of the Program, in our absolute discretion, we will send you a written notice, drafted clearly and legibly, explaining the change and/or setting out the new clause, and the effective date of the change. The notice may be sent to you by electronic transmission, when applicable. Any other changes to the Program will be posted to the Program webpage at https://referralawards.rbc.com before the change comes into force.

13.Suspension and Termination of the Program:

(a)
Should events beyond our control, such as strikes, acts of God, epidemic or pandemic, civil disturbance, war or changes in economic or business conditions, materially affect our ability to perform, the Program may be suspended or terminated and your Recognitions may be forfeited without notice to you.
(b)
We may also suspend or terminate the Program for any reason, at any time upon ninety (90) days’ prior notice to you
(c)
Further, we may, without notice, suspend or terminate your participation in the Program upon fraud or abuse by you relating to the Program, misrepresentation of information to us, or failure by you to comply with these Terms and Conditions. If you are a Points Member, we may also close your Credit Card Account or your Eligible Banking Rewards Account, as applicable, and cancel your Points in accordance with the Avion Rewards Terms.
(d)
You may withdraw from the Program at any time, by sending us a notice at: Connect with your Mortgage Specialist for assistance.. If you withdraw from the Program, the Non-Points Recognition(s) that you may be entitled to, but that has not yet taken place, will be automatically forfeited. However, if you are a Points Member, all Points earned as of the date of such withdrawal, whether or not they have been credited to your Rewards Account at that time, will remain available to you, subject to the Avion Rewards Terms. 
(e)
If you close your Credit Card Account/Card or Eligible Banking Rewards Account, all your Points will remain available for twelve (12) months following the closure of your Credit Card Account/Card or Eligible Banking Rewards Account. For complete details, please refer to the Avion Rewards Terms.
(f)
Termination or suspension of the Avion Rewards Program, and termination of your participation in the Avion Rewards Program are governed by the Avion Rewards Terms.

14.Communications:

(a)
We may send you notices by ordinary mail or by email, directed to your address last appearing in our records. We may also share important information about the Program on the Program web site at https://referralawards.rbc.com .
(b)
You are responsible for keeping your Program profile and contact information up to date at all times. To update your profile and contact information, you will log-in to your account at https://referralawards.rbc.com and select “Update Profile”.

15.Interpretation:

All questions or disputes regarding the Program and the interpretation of these Terms and Conditions will be resolved by us in our sole discretion.

16.Governing Law:

These Terms and Conditions will be interpreted in accordance with the law applicable in the province in which you reside.

17.Severance:

If any one or more of the provisions of these Terms and Conditions shall be or become invalid, illegal or unenforceable under any applicable law, the validity, legality or unenforceability of the remaining provisions shall not in any way be affected or impaired.
